Your community, governed by Midway Crossing Homeowners Association, is a private, non-profit organization. The members of the Homeowners Association are all the individual owners in Midway Crossing, which is comprised of 95 homes. You are automatically a member of the Homeowners Association upon your purchase of property in the community. Membership is mandatory. A Board of Directors, elected by the members, manages the Homeowners Association.

The purpose of the association is to establish rules of conduct for the common good of the community. The Homeowner's Association will review architectural modifications and enforce the rules and restrictions as set out in the CCR's (Deed Restrictions) uniformly. The Homeowner's Association is also responsible for the enforcement of the regulations governing the appearance of each house and yard and, in addition, it is responsible for the repair and maintenance of the landscaping of the Midway Crossing common areas. This allows the Homeowners Association to protect the investment of each individual as well as enhance the value of everyone's property.

The Homeowner's Association will enforce the Deed Restrictions, which are outlined in the legal documents you received at closing. Please review all paperwork that you received to ensure that you have received a copy. If you did not, please contact your title company. Typically, these restictions establish architectrual standards, govern the use of the property within the community, and require that prior written approval from the Board of Directors be obtained for all modifications to your house.

Each owner and occupant of each house shall maintain the yards in a sanitary and attractive manner including adequate watering and immediate replacement of dead grass/vegetation and shall edge the street curbs that run along the boundary lines of the property. Grass, weeds and other vegetation on each lot must be kept mowed and trimmed at regular intervals so as to maintain the lot in a neat and attractive manner.

 

TRASH PICK UP
The city of Dallas has provided trash containers which should be positioned such that the trash truck can easily grasp the container. Trash and recycables are picked up on Friday morning (EARLY). The city will also pick up brush and bulk trash if left curb side prior to 7:00 am of the first Monday of each month. Materials not collected as bulky trash are, bagged grass clippings, new or remodeling construction materials, rocks, bricks, concrete or dirt. Call 214-670-8613 for further information. To get a blue trash can for recyclables, call 311. You can also use blue plastic bags for recycables which can be purchsed at Albertsons at Frankford and the Tollway.

" Before you haul your old couch to the curb, you might want to check the calendar. Dallas is cracking down on residents who jump the gun on bulky trash disposal. Beginning August 1, 2003, homeowners who dump their debris more than four days before their scheduled pickup week will be slapped with a citation and a fine of up to $175.00. Last year, the city had more than 14,000 complaints about bulky garbage. Under the new policy, the city will pick up trash that has been discarded prematurely after a citation has been issued."

The following information was found in the October 27, 2002 edition of the Dallas Morning News:

Additionaly, per the July/August 2003 issue of the AARP BULLETIN, "Americans who want to block unwanted telemarketing calls can call the Federal Trade Commission's (FTC) toll-free telephone number (888) 382-1222, TTY:(866) 290-4236, or go to its web-site at www.donotcall.gov to be listed on the new Do Not Call Registry."

HAND-BILLS / ADVERTISING FLYERS
The following is from the Dallas Morning News October 27, 2002. Dallas City Code Section 7A-13, Ordinance 10371 states that "No person shall throw, deposit or distribute commerical advertising on any private premises, if requested by anyone thereon not to do so, or if there is placed on such premises in a conspicuous position near the entrance thereof, a sign bearing the words 'No Trespassing,' 'No Peddlers or agents,' 'No Advertisement,' or any similar notice indicating in any manner that the occupants of such premises do not desire to be molested or have their right of privacy disturbed or to have any such handbills left upon such premises." The initial fine is $500 for violation of this ordanance with a max of $2,000.
